Better Buzz does not manufacture most of the products sold through the website.

4. Eligibility and Minimum Age Requirements

The Better Buzz website is intended for adults.

As a Better Buzz company policy, customers must be at least 18 years of age to purchase products from Better Buzz.

Certain products have a higher minimum age requirement.

Nicotine Alternative and Nicotine Analogue Products

Nicotine Alternative Products and Nicotine Analogue Products may only be purchased by individuals who are 21 years of age or older, or the higher minimum age required by applicable law.

Better Buzz may require age verification before allowing the purchase or shipment of these products.

Customer Representation

By using the Services or placing an order, you represent that:

  • Restrict products based on Better Buzz compliance policies.

A product being displayed on the website does not mean that it is available for purchase or shipment to every location.

Certain products may only be available in certain jurisdictions.

7. State and Local Legal Restrictions

Better Buzz does not ship Nicotine Alternative Products or Nicotine Analogue Products to Denver, Colorado.

California

Better Buzz does not sell or ship flavored Nicotine Alternative Products or Nicotine Analogue Products to California where such products are prohibited or restricted by applicable law.

Where legally permitted, eligible unflavored nicotine alternative or nicotine analogue products may remain available in California.

Future Regulatory Changes

Laws and regulations may change.

If a jurisdiction adopts or changes a law, regulation, restriction, prohibition, licensing requirement, flavor restriction, age requirement, or other requirement affecting a product sold by Better Buzz, we may restrict or discontinue sales or shipments to that jurisdiction.

12. Orders

When you place an order, you are submitting a request to purchase the selected products.

Submitting an order does not guarantee that Better Buzz will accept the order.

14. Order Acceptance

Better Buzz may cancel an order before shipment when reasonably necessary, including because of:

  • Failed payment

  • Failed age verification

  • Failed identity verification

  • Fraud concerns

  • Product restrictions

  • Shipping restrictions

  • Inventory problems

  • Pricing errors

  • Product recalls

  • Manufacturer restrictions

  • Violation of these Terms

  • Regulatory requirements

Eligible refunds for cancelled orders will be handled according to the applicable refund procedures.

15. Order Cancellation by the Customer

Customers may request cancellation of an order at any time before fulfillment begins.

There is no cancellation fee for an approved cancellation requested before fulfillment.

Once an order has entered fulfillment, it cannot be cancelled.

If an order has already shipped, cancellation is not available. Customers may refuse delivery where possible, but Better Buzz does not guarantee that a shipment can be stopped or cancelled.

Approved cancellations will be refunded according to the Order Cancellation Policy.

16. Order Changes

Customers should contact Better Buzz Customer Support as soon as possible if they need to change an order.

Before fulfillment begins, Better Buzz may be able to modify certain order information.

Once fulfillment begins, changes may no longer be possible.

Better Buzz cannot guarantee changes to:

  • Products

  • Quantity

  • Shipping address

  • Billing information

  • Shipping method

  • Payment method

  • Promotional codes

17. Pricing

All prices are displayed in U.S. Dollars unless otherwise stated.

Prices may change at any time.

If a product is listed at an incorrect price, Better Buzz may:

  • Cancel the affected order.

  • Refund payment already collected for the affected order.

The amount displayed at checkout may vary depending on the customer's location and the products purchased.

Better Buzz accepts the payment methods made available through checkout. Available payment methods may vary based on location, product type, order value, payment provider, device, and other applicable factors.

Legal Entity: Better Buzz is operated by GETBETTERBUZZ INC., which is the legal entity responsible for purchases made through the website. GETBETTERBUZZ INC. is the legal business name that may appear on your credit card, debit card, bank statement, receipt, or other billing record.

By submitting payment information, you confirm that you are authorized to use the selected payment method.

Better Buzz and its payment providers may perform payment authorization, verification, and fraud screening. Payments or orders may be declined, delayed, or require additional verification when necessary.

21. Promotions and Discounts

Better Buzz may offer:

  • Discount codes

  • Promotional pricing

  • Bundles

  • Special offers

  • Loyalty rewards

  • Subscription discounts

  • Limited-time promotions

Unless expressly stated otherwise:

  • Promotions cannot be combined.

The Loyalty & Rewards Program is governed by the separate Loyalty & Rewards Program Terms.

Better Buzz reserves the right to modify, suspend, or discontinue the program in accordance with the applicable Loyalty & Rewards Program Terms.

23. Subscriptions

Certain products may be available through recurring subscriptions.

Subscription purchases are governed by the separate Subscription Terms.

Customers may generally manage their subscriptions before the next scheduled fulfillment date, including:

  • Changing products

  • Changing quantities

  • Changing shipping addresses

  • Skipping shipments

  • Pausing subscriptions

  • Cancelling subscriptions

Once a subscription order enters fulfillment, that individual order cannot be cancelled.

Subscription charges, renewal schedules, and other subscription-specific rules are described in the Subscription Terms.

24. Purchase Options

Better Buzz may offer products as:

  • One-time purchases

  • Subscription purchases

Better Buzz does not currently offer:

  • Pre-orders

  • Try Before You Buy

Purchase options may vary by product and location.

25. Shipping and Delivery

Better Buzz ships eligible products to locations where the applicable products may legally and compliantly be sold and shipped.

Shipping availability may vary based on:

  • Product

  • Destination

  • Applicable law

  • Age requirements

  • Manufacturer restrictions

  • Carrier requirements

  • Better Buzz compliance policies

Orders are generally processed within 1–2 business days, excluding weekends, holidays, severe weather events, and periods of unusually high order volume.

Processing time is separate from shipping transit time.

Available shipping methods and carriers may include:

  • UPS

  • USPS

  • FedEx

Express or expedited shipping may be available for some orders and destinations but is not guaranteed to be available for every order.

Free shipping is currently available on qualifying orders of $50 or more, subject to change.

26. Delivery Estimates

Shipping and delivery dates provided at checkout are estimates unless expressly stated otherwise.

Delivery may be affected by:

  • Carrier delays

  • Weather

  • Holidays

  • High shipping volume

  • Incorrect customer information

  • Government actions

  • Transportation disruptions

  • Other circumstances outside Better Buzz's reasonable control

Selecting expedited shipping does not necessarily mean that an order will be processed the same day.

27. Age-Restricted Delivery

Certain products or destinations may require:

  • Other delivery verification

If required identification or an eligible adult is unavailable, delivery may not be completed.

28. Returns, Refunds and Replacements

Because many Better Buzz products are consumable, Better Buzz generally does not accept returns after delivery.

If you receive:

  • A damaged product

  • A defective product

  • The wrong product

  • A missing product

  • An incorrect quantity

you may contact Customer Support for review.

Order issues must generally be reported within 5 calendar days of delivery.

For approved claims, Better Buzz may provide an appropriate remedy, including:

  • Replacement

  • Refund

  • Partial refund

  • Store credit

If the wrong product was shipped, the customer may keep the incorrect product unless Better Buzz specifically provides different instructions.

29. Delivered but Missing or Stolen Packages

If tracking confirms that a package was delivered but the customer cannot locate it, Better Buzz may assist with a carrier investigation.

Customers should first:

  • Verify the shipping address.

  • Check the delivery location.

  • Ask household members or neighbors.

  • Contact the carrier.

Better Buzz generally does not guarantee refunds or replacements for packages confirmed as delivered but subsequently reported missing or stolen, except where required by applicable law.

30. Customer Shipping Information

Customers are responsible for providing accurate shipping information.

This includes:

  • Full name

  • Street address

  • Apartment or unit number

  • City

  • State

  • ZIP code

  • Phone number

Better Buzz is not responsible for delays, additional costs, or delivery problems resulting from inaccurate or incomplete information provided by the customer.

31. Refused and Undeliverable Packages

A package may be returned to Better Buzz because of:

  • Failed delivery attempts

  • Incorrect address

  • Refused delivery

  • Unclaimed package

  • Failure to provide required identification

  • Failure to provide an adult signature

  • Other delivery problems

Any refund or reshipment will be handled according to the applicable Shipping and Return & Refund Policies.

Where permitted by law, applicable shipping, carrier, return, or other fees may be deducted from an eligible refund.

32. Chargebacks and Payment Disputes

If you experience a problem with an order or payment, we encourage you to contact Better Buzz Customer Support before initiating a chargeback or payment dispute.

If a chargeback is initiated, Better Buzz may provide relevant documentation to the payment processor, including:

  • Order information

  • Payment records

  • Shipment records

  • Tracking information

  • Delivery confirmation

  • Age verification information where legally permitted

  • Customer communications

  • Other relevant records

Fraudulent or abusive payment disputes may result in restrictions on future purchases or accounts where permitted by law.

33. Fraud and Abuse

Better Buzz may take action against activity that appears fraudulent, abusive, deceptive, or intended to circumvent our policies.

  • False damage claims

  • False delivery claims

  • Repeated fraudulent refund requests

  • Chargeback abuse

Better Buzz may cancel orders, restrict accounts, remove promotional or loyalty benefits, or restrict future purchases where permitted by law.

You are responsible for:

Third-party brands retain ownership of their respective:

  • Logos

  • Brand names

  • Manufacturer-provided materials

  • Other intellectual property

Nothing in these Terms transfers ownership of third-party intellectual property to Better Buzz or to customers.

Better Buzz sells products from independent third-party brands and manufacturers.

Manufacturers are generally responsible for their own:

Better Buzz does not guarantee that a third-party product will meet every customer's individual expectations or needs.

Better Buzz is not responsible for third-party websites or services that it does not control.

Your use of the Services is also governed by the Better Buzz Privacy Policy and Cookie Policy.

Those policies explain how Better Buzz collects, uses, stores, and shares information.

The Privacy Policy currently explains that Better Buzz uses Shopify to operate the store and may share information with service providers involved in payment processing, analytics, customer support, fulfillment, shipping, advertising, and other business operations.

40. SMS and Marketing Communications

If you voluntarily subscribe to Better Buzz marketing communications, you may receive promotional messages by email or SMS.

SMS communications may be provided through Klaviyo.

You may opt out of marketing communications according to the applicable communication instructions.

Order-related and other transactional communications may still be sent when necessary to provide Services or communicate about your account or orders.

41. Accessibility

Better Buzz is committed to providing an accessible online shopping experience and continually works to improve the accessibility and usability of the Services.

Accessibility information and methods for reporting accessibility issues are provided in the Accessibility Statement.

42. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided on an "as available" and "as is" basis.

Better Buzz does not guarantee that:

  • The website will always be available.

  • The Services will always operate without interruption.

  • Website information will always be complete or error-free.

  • Products will always be available.

  • Products will be suitable for every individual.

  • Shipping will always occur within a particular timeframe.

  • Third-party services will always operate without interruption.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable law.

43. Limitation of Liability

To the maximum extent permitted by applicable law, Better Buzz will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Services or purchase or use of products.

To the extent permitted by law, Better Buzz's total liability relating to a particular transaction will not exceed the amount actually paid to Better Buzz for the product or service giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

44. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Better Buzz and its affiliates, officers, employees, contractors, service providers, and representatives from claims, liabilities, damages, losses, and expenses arising from:

Any dispute arising from or relating to the Services, these Terms, or a purchase from Better Buzz will be handled according to the dispute-resolution requirements and applicable law governing the transaction.

Better Buzz reserves the right to update this section with the applicable governing-law jurisdiction and dispute-resolution procedures.

50. Consumer Rights

Nothing in these Terms is intended to limit, waive, or exclude any rights or protections that cannot legally be waived under applicable federal, state, or local law.

Where applicable law provides consumers with rights that conflict with these Terms, the applicable law will control.
